The petitioner seeks bail in connection with Banka P.S. Case No. 867 of 2018 registered under Sections 395 and 398 of the Indian Penal Code.
Considering the submission made by the learned counsel for the petitioner that the name of the petitioner transpired in course of investigation in the confessional statement of one Mahesh Kumar, a co-accused, who had disclosed about complicity of the petitioner along with Sibu Yadav, Sujit Yadav and Mantu Yadav in commission of the offence and said Sibu Yadav and Sujit Yadav have already been granted bail by a Bench of this Court vide order dated 01.04.2019 passed in Cr.Misc. No. 19651 of 2019 and Mantu
Patna High Court CR. MISC. No.33653 of 2019(22) dt.22-05-2019 2/2 Yadav has been granted bail vide order dated 25.04.2019 passed in Cr.Misc. No. 27140 of 2019, the petitioner, who is in custody since 11.01.2019, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 867 of 2018, subject to the conditions : (a) that the petitioner shall attend court in accordance with the conditions of the bond executed;
(b) that the petitioner shall not commit an offence similar to the offence of the present case; and (c) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
