His simple prayer is that he may be allowed to withdraw this application with liberty to move before the competent authority in the light of the judgment of the Hon'ble Division Bench of this Court in the case of Umesh Sah Vs. State of Bihar reported in 2020 (3) PLJR 931. Mr. Vikash Kumar, learned SC-11 has no objection if the petitioner seeks his remedy before the competent

Patna High Court CR. WJC No.780 of 2022(3) dt.10-11-2022 2/2 authority in accordance with law with the Hon'ble Division Bench judgment.

In the aforesaid view of the matter, as prayed, the writ application is permitted to be withdrawn with liberty to the petitioner to seek his remedy in the light of the Hon'ble Division Bench Judgment of this Court in the case of Umesh Sah (supra). If any such application is filed before the competent authority, the same will be considered at the earliest opportunity and will be disposed of within reasonable period preferably within a period of three months from the date of filing of the application.
