2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 504, 506, 354-B, 354-D/34 of the Indian Penal Code and sections 8, 12 of the Protection of Chidren from Sexual Offences Act, 2012 ( herinafter referred to as POCSO Act).
3. Allegation against this petitioner is that he along with other co-accused persons used to harass the victim and molest her. It is further alleged that when the victim was on Barh station with his family, meanwhile this petitioner and other
Patna High Court CR. MISC. No.38902 of 2023(3) dt.04-08-2023 2/3 co-accused persons abused and threatened her and forcibly tried to take her with themselves.
4. It is submitted that both the parties are neighbours and due to dispute over a drain, petitioner has falsely been implicated in this false and concocted case. In fact on the date of occurrence this petitioner was going to his maternal grandmother's house and when he saw some people were harassing the victim then he tried to save her but victim, out of some confusion named this petitioner as culprit. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A . D. J. VI th,-cumSpl- Judge P . O . C . S. O . Patna in connection with Spl. (POCSO) Case No-15/2023, arising out of Barh P.S. case no 837 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal
