====================================================== CORAM: HONOURABLE MR. JUSTICE PRAVEEN KUMAR ORAL ORDER 21-05-2026 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through videoconferencing.

2. This application for anticipatory bail arises out of Bairiya P.S. Case No. 107 of 2026, registered for the offence punishable under Sections 80(2) and 3(5) B.N.S.

3. As per the allegation, the petitioner, who happens to be the cousin brother of the husband of the deceased, along with co-accused persons, had killed the sister of the informant for non-fulfillment of dowry demand.

4. Learned counsel for the petitioner has submitted that the petitioner happens to be the cousin brother of the husband of the deceased and he resides separate in mess and residence and has got no concern with the deceased or her husband. It has further been submitted, referring to paragraph 11

Patna High Court CR. MISC. No.35191 of 2026(2) dt.21-05-2026 2/2 of the anticipatory bail application, that the husband of the deceased is in judicial custody. It has further been submitted, referring to the impugned order, that the death of the deceased was opined to be due to asphyxia as a result of hanging, as per the post mortem report. It has further been submitted that there is general and omnibus allegation against the petitioner. It has lastly been submitted that the petitioner has got no criminal antecedent.

5. Learned counsel for the State opposed the prayer of anticipatory bail of the petitioner.

6. Heard the parties and perused the record.

7. Considering the facts and circumstances, let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. 1st class, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 107 of 2026, subject to the conditions as laid down under Section 482(2) of the Bhartiya Nagrik Suraksha Sanhita.
