2. The petitioner is seeking regular bail in connection with Beldaur P.S. Case No. 447 of 2024, registered for the offences punishable under Sections 96, 351(2), 352 and 3(5) of the BNS.

3. According to allegation, seven accused persons including the petitioner, kidnapped the minor daughter of the informant.

4. The learned counsel for the petitioner has submitted that the age of the victim, according to FIR, is 17 years, which shows that she is on the verge of majority. As a matter of fact, she had love and affection with the petitioner and she went herself with the petitioner. He has further submitted that in

No.34470 of 2025(4) dt.12-09-2025 2/2 paragraph no. 13 of the case diary, the statement of the victim under Section 180 of the BNSS was recorded, in which she has stated that she was in love with the present petitioner and they wanted to marry each other. The learned counsel has submitted further that on the pressure of her parents, she retracted from her version and supported the prosecution case in her statement recorded under Section 183 of the BNSS. The petitioner is under custody since 27.12.2024.

Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Beldaur P.S. Case No. 447 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
