1. The present writ petition has been filed seeking the following relief(s):- "1.(i) For setting aside letter dated 14.06.2021 contained in 541/K.H.P. issued by Special Work Officer, Central Selection Parasid (Police Recruitment), Bihar, Patna whereby and where under petitioner was declared unsuccessful. (ii) For giving direction to Respondent authority to declare successful in Advertisement No. 2/2019 regarding Central Selection Parasid (Police Recruitment), Bihar, Patna."

2. At the outset, the learned counsel appearing for the

Patna High Court CWJC No.14380 of 2021(2) dt.04-01-2024 2/2 respondent-Central Selection Board (Constable Recruitment), Bihar, Patna, has referred to the counter affidavit filed in the present case to submit that the petitioner has obtained only 58 marks, whereas the cut off marks for his category is 66 marks, hence he has been declared unsuccessful.

3. The aforesaid contention raised by the learned counsel for the respondent-Board has remained unrefuted, hence, the learned counsel for the petitioner submits that since the petitioner has not attained the cut off marks for his category, nothing survives for consideration, thus the present writ petition be disposed off.

4. Accordingly, the present writ petition stands disposed off.
