JUSTICE MUNGESHWAR SAHOO ORAL ORDER 18-12-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State. Heard learned counsel for the informant also. Petitioners, namely, Shyam Sundar Sah, Deo Sharan Sah, Ram Sharan Sah and Chetan Sah are in custody in Sursand P.S. Case No.143 of 2014 under Sections 302, 201 and 34 of the Indian Penal Code.
According to the F.I.R., in the morning of the occurrence the accused Lal Bihari Sah had assaulted the informant and, therefore, the informant along with her husband had gone to police station for lodging F.I.R. and when they returned they found that the dead body of their daughter aged about 11 years
Patna High Court Cr.Misc. No.55820 of 2015 (2) dt.18-12-2015 was found in the pond. Therefore, the informant suspected that the accused person Lal Bihari Sah and these petitioners and other coaccused persons might have murdered the deceased daughter of the informant because there is land dispute prior to the occurrence between the parties.
It appears that the accused person Lal Bihar Sah whose case is on same footing has already been granted bail by this Court. It further appears that only on suspicion the petitioners have been arrested and are in custody since 20.07.2015. Considering the above facts of the case I direct that all the petitioners named above be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri, District-Sitamarhi in connection with Sursand P.S. Case No.143 of 2014.
