Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State.

This application for grant of regular bail arises out of Katoria P.S. Case No. 103 of 2015, disclosing offences under Sections 302 and 201/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner has submitted that petitioner's implication in the case is based on mere suspicion. He has also submitted that even in course of investigation, no material worth evidence has come to implicate the petitioner with the offence. The petitioner is in

Patna High Court Cr.Misc. No.47408 of 2015 (2) dt.27-10-2015 2/2 custody since 16.05.2015.

Considering the submission aforesaid and the fact that petitioner is a lady, having no criminal antecedent, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Banka in connection with Katoria P.S. Case No. 103 of 2015.

This is subject to the condition that the petitioner shall present herself before the police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
