JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 3(E), 3(8), 15 and 18 of the Mahua Flower Act.
24 plastic bags each containing 35 kgs. of Mahua flower have been recovered from a pickup van when it was found that the petitioner was the owner of the vehicle in question. It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that the petitioner was present in the vehicle and recovery has been made from a public vehicle. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the quantity of recovery, this Court is not
Patna High Court Cr.Misc. No.3674 of 2016 (2) dt.25-01-2016 2/2 inclined to grant anticipatory bail to the petitioner. Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Jamhora P.S. Case No. 80 of 2015 pending in the court of learned CJM, Aurangabad. Accordingly, the application is disposed of.
