2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code.

3. As per prosecution case, the informant alleged that her husband was assaulted by the petitioner along with other coaccused persons causing his death.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity. It is further submitted from para-5 of this petition that petitioner is an old man and ailing person. It is quite impossible that someone having killed the husband of the informant

Patna High Court CR. MISC. No.40462 of 2024(2) dt.25-06-2024 2/2 intentionally would inform the informant through her son and board the deceased in the vehicle to carry him to the hospital. So, it is apparently false case lodged by the informant. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Other co-accused person has already been granted bail by another co-ordinate Bench of this Court vide order dated 03.08.2022 in Cr. Misc. No. 62009 of 2021. Moreover, the petitioner is languishing in judicial custody since 12.03.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6.Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dhoraiya P.S. Case No. 69 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka.
