The present application has been filed for quashing the order dated 17.05.2016 by which learned Sub Divisional Judicial Magistrate, East Muzaffarpur, has taken cognizance against the petitioners in Complaint Case No. 3097/2015, corresponding to Trial No. 2098/2017, registered under Sections 498A of the Indian Penal Code.
3. As per prosecution, opposite party no. 2 was married with accused no. 1 on 07.07.2008 according to Hindu rites and rituals. Her father had fulfilled the demand of accused
Patna High Court CR. MISC. No.12372 of 2017(3) dt.20-09-2023 2/2 persons with household articles, clothes and ornaments worth Rs. One lac only. The demand of motorcycle could not be fulfilled due to which resulting into Complaint Case No. 1190/2011.
4. Accordingly, this application is disposed of with liberty to the petitioners to raise all the grounds at the stage of framing of charge.
