Ms. Anita Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-08-2025 Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 111(1), 310(4) and 310(5) of the B.N.S., Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 8(c) and 21(b) of the N.D.P.S. Act.

3. As per prosecution case, on secret information, a raid was conducted and three accused persons were apprehended at the spot with illegal arms and ammunition and more than 10 grams of smack, who disclosed the name of this petitioner as their associate who managed to flee away from the spot.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has

Petitioner has been made an accused in this case merely on the basis of confessional statement of coaccused person who was apprehended on the spot with illegal arms and ammunition and more than 10 grams of smack. No incriminating article has been recovered from possession of this petitioner. Except confessional statement, there is no material on record to show the complicity of this petitioner in the alleged occurrence.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R.. Petitioner has got one criminal antecedent.

6. Considering the facts and circumstances of the case, nature of accusation and criminal antecedent of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected.
