The petitioner's grievance in this writ petition, made under Articles 226 and 227 of the Constitution of India, is that Dr. Sudhir Kumar Sinha, who had conducted the post mortem examination on the dead body of deceased Niraj Kumar, has not been examined; whereas Mr. H.S. Sundaram, learned Assistant Counsel to learned Standing Counsel No.8, appearing on behalf of the State respondents, has, now, submitted the said doctor has already been examined by the trial Court on
Patna High Court Cr. WJC No.910 of 2016 (4) dt.29-09-2016 2/2 14.09.2016.
In view of the above, the present writ petition has, admittedly, become infructuous and is, accordingly, disposed of as having become infructuous.
