Petitioner apprehends arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.
Informant alleges that he got the information that his missing minor daughter aged about 16 years was seen with the petitioner who always used to talk with her.
Learned counsel for the petitioner, referring to section 164 Cr.P.C. statement of the victim (Annexure 2), submits that the girl has herself stated that she has solemnized the marriage with the petitioner out of her own sweet will and she wants to live with him. The Court below has assessed the age of the girl as 18 years. Petitioner has no criminal antecedent. Considering the facts of the case, let the petitioner,
Patna High Court CR. MISC. No.34724 of 2019(2) dt.28-05-2019 2/2 above named, in the event of his arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kavindra Kumar, Judicial Magistrate 1st class, Pupri at Sitamarhi in Sursand Police Station Case No. 191 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
