The petitioner being the husband of the victim is apprehending arrest in connection with Mehsi P.S. Case No.28/2014 registered for the offences punishable under Sections 498A, 323, 324, 326, 304B/34 of the Indian Penal Code, pending before the learned Judicial Magistrate, Sadar, Motihari, East Champaran..

Prosecution case is of killing the sister of the informant, namely, Shobha Devi, after four years of marriage for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that specific accusation of assault is against Lavkush, who is brother of the petitioner.

Patna High Court Cr.Misc. No.2907 of 2016 (2) dt.25-01-2016 2/2 Considering the nature of accusation and the petitioner being husband of the victim, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for bail on behalf of the petitioner is rejected.
