The petitioner apprehends his arrest in connection with Naugachiya P.S. Case No. 11 of 2019, registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)1 and 26/35 of the Arms Act.

The accusation is that on receiving secret information about gathering of miscreants at Naugachiya Choisa Road, the informant along with other police personnel reached there. On seeing the police personnel, the miscreants started to flee away but on chased, one person was apprehended with one country made loaded pistol, who disclosed his name as Pyare Lal Mandal and also disclosed the name of seven persons

Patna High Court CR. MISC. No.33395 of 2019(2) dt.21-05-2019 2/2 including the petitioner, who succeeded to flee away. Learned counsel for the petitioner submits that petitioner has not been apprehended at the spot but in the confessional statement of Pyare Lal Mandal, the name of the petitioner has surfaced in the present case and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Naugachiya, Bhagalpur, in connection with Naugachiya P.S. Case No. 11 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
