2. The petitioner apprehends his arrest in connection with Begusarai FCI P.S. Case No. 30 of 2024, registered for the offences punishable under Sections 191(2), 127(2), 115(2), 308(4), 352, 351(2) of BNS.
3. Allegedly, on 02.08.2024, on the request made by some of the friends, the informant reached at the place of occurrence to participate birthday of one of his friend Fantush. While they assembled there, in the meanwhile, one Raja Kumar came there and took him along with his friends to an underconstructed house where all of them, seven in numbers, abused and tied him and his friends, thereupon on the point of pistol, they demanded rangdari of Rupees One Lakh each and threatened to murder. Subsequently, the informant asked his family members to pay Rs. One Lakh on his mobile and after receiving the same, one Chikku Kumar snatched the mobile of
Patna High Court CR. MISC. No.38356 of 2025(3) dt.03-09-2025 2/3 the informant and transferred some amount to different accounts through PhonePe and lastly he transferred Rs.50,500/- to one Ayushi Computer Centre.

Learned Advocate for the petitioner submitted that the petitioner was not even present at the place of occurrence and only on account of he being the owner of the Aayshi Computer Centre, his name has been implicated. He further submits that an amount was withdrawn from Common Service Centre (CSC) which is run by the petitioner in the name and style of Ayushi Computer Cnetre and no amount has been credited in the personal account of the petitioner. It is further contended that the petitioner was also served notice under Section 35(3) of the BNSS on 24.11.2024; the police also reached the shop of the petitioner and recorded his statement but later on the name of the petitioner has been implicated in this case and prayed for warrant, hence the petitioner approached this Court. The petitioner bears absolutely fair antecedent and he undertakes that he will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that there is serious allegation against the petitioner that he received
Patna High Court CR. MISC. No.38356 of 2025(3) dt.03-09-2025 3/3 Rs.50500/- in his account from the PhonePe of the victim, who was kidnapped by other accused persons.

Having considered the submissions set forth by the learned Advocates for the respective parties and taking note of the fact that the petitioner is not named in the FIR and only on account of be being the owner of the Ayushi Computer Centre, his name has been implicated in this case, besides the fair antecedent and the fact that on notice under Section 35(3) of BNSS, he has fully cooperated with the Investigating Officer, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai FCI P.S. Case No. 30 of 2024, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
