JUSTICE ASHUTOSH KUMAR ORAL ORDER 26-03-2021 Mr. Ajay Kumar Singh, learned counsel for the petitioners is permitted to correct the address of the petitioners by adding the name of the father of the petitioner no. 2 in the bail petition.

The petitioners seek bail in anticipation of their arrest in connection with Ara Nawada P.S. Case No. 221/20 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

The son of the petitioner no. 1 who is also the brother of the petitioner no. 2 is said to have been arrested with bottles of beer and liquor. He is said to have named the

The petitioners have clean antecedents and have been made accused in this case only at the instance of the brother of the petitioner no. 2 Learned counsel for the petitioners has submitted that the brother is separate in mess and business from the petitioners and because of enmity, he has taken the names of the petitioners also.

Regard being had to the afore-stated facts, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 4th Sessions Judge -cum-Special Judge, Excise, Bhojpur at Ara, in connection with Ara Nawada P.S. Case No. 221/20, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
