2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 406, 420, 467, 468 and 120B of the Indian Penal Code.
3. As per prosecution case, it is alleged that all the F.I.R. named accused persons, executed forged and fabricated sale deed in favour of this petitioner without any right, title and possession over 4 dhur land of informant.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. As a matter of fact, petitioner is bona fide purchaser of the land in question and has purchased the
Patna High Court CR. MISC. No.48164 of 2025(3) dt.02-12-2025 2/3 same after payment of due consideration money. The land in question belonged to the vendors at the time of execution of sale deed in favour of petitioner. After purchasing the land, the petitioner came in possession of the land in question and a double stories building has been constructed over the land and the same is in occupation of the petitioner. Moreover, the vendor, namely Manoj Kumar, has already been granted regular bail by this Hon'ble Court vide order dated 11.04.2025 passed in Cr. Misc. No. 14057 of 2025. Moreover, the dispute is with regard to sale and purchase of land which is purely civil in nature.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the facts and circumstances of the case and nature of dispute, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
