In this case, the petitioner is seeking bail in connection with Chhatapur P.S. Case No. 114 of 2015 registered for offences under sections 302, 341, 323 and 504 of the Indian Penal Code.
As per the prosecution story, wife of the information used to keep a very bad health. On the fateful day, the accused person picked up the quarrel with his wife and started abusing and also assaulting her whereupon when the informant objected, the petitioner also started abusing and assaulting him with fists and slaps whereupon the informant's wife tried to intervene in the matter, she was pushed and fallen on the ground due to which she
Patna High Court Cr.Misc. No.49768 of 2015 (2) dt.06-11-2015 2/2 became senseless and was brought to the hospital there she was declared dead.
The counsel for the petitioner submits that there was no intention to kill the victim, but it is an accidental if the fact of the first information report is taken to the face value. The petitioner is in custody since 2/6/2015.
Looking to the nature of allegation, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Supaul in connection with Chhatapur P.S. Case No. 114 of 2015.
