This case was listed before another Bench but the same has been listed today on mentioning that he is suffering from stomach ailment and has been advised treatment. The Court below has also directed for taking the petitioner to a hospital under police protection.

The petitioner seeks bail in connection with Runnisaidpur P.S. Case No. 491 of 2020 dated 08.10.2020 registered for the offences under Sections 414 of the Indian Penal Code and 30(a), 38(i)(ii) and 41 of the Bihar Prohibition and Excise Act, 2016.

Apart from the aforesaid accusation, there is no other material in the police papers justifying the custody of the petitioner since 16.06.2021.

Regard being had to the aforesaid facts and taking into account the poor health of the petitioner, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Runnisaidpur P.S. Case No. 491 of 2020 to the satisfaction of the Additional District Judge II-cum-Special Judge, Excise Act, Sitamarhi.
