JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 13-07-2016 The present M.J.C. application has been filed for restoration of Civil Review No. 365 of 2011, which stood dismissed on account of non compliance of the Court's peremptory order dated 13.11.2014.

Taking into consideration the submissions of the learned counsel for the petitioner as also the averments made in the present M.J.C. application, the prayer for restoration is

Patna High Court MJC No.308 of 2016 (2) dt.13-07-2016 allowed. Civil Review No. 365 of 2011 is directed to be restored to its original file, subject to the condition that the order dated 13.11.2014 passed in the aforesaid Civil Review No. 365 of 2011 must be complied with within two weeks from today and subject to a further condition that the petitioner shall deposit a cost of Rs.1000/- (rupees one thousand) with the Patna High Court Legal Services Committee within the same period of time. If the present order is complied with within the time prescribed above, then the matter shall be listed before an appropriate Bench, as per roster, after obtaining necessary permission from Hon'ble the Acting Chief Justice, and it shall no longer be treated as a part heard or tied up matter to this Bench. The present M.J.C. application stands allowed to the extent indicated, but with the observation/direction made above.
