2. The petitioner is seeking regular bail in connection with Brahampura P.S. Case No. 56 of 2024 for the offences punishable under Section 376(D) of the Indian Penal Code.

3. As per allegation, the marriage of the victim was solemnized with the petitioner on 17.12.2023. After marriage, the accused persons, including the petitioner, started torturing her. It is further alleged that the accused persons i.e. Bhaisur (the petitioner) and Chachera Sasur forced their entry into the room of the victim by pushing her inside and committed rape upon her.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

He has further submitted that from bare perusal of the FIR and the restatement of the victim, it appears that the case has falsely been lodged. The restatement shows that even her husband did not believe the allegation made by the informant. The petitioner is a person of clean antecedent and is under custody since11.03.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned J.M.F.C., Muzaffarpur (East) in connection with Brahampura P.S. Case No. 56 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
