CORAM: HONOURABLE MR. JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 10-12-2015 Above noted all the three applications have arisen out of one occurrence i.e. Mithanpura P.S. Case No. 200 of 2015 registered for the offences under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code as such they have been heard together and are being disposed of by this common order. The petitioners and others participated in the process of selection for appointment to the post of constables in Bihar Military Police and they have been found involved in malpractices to get themselves selected as their signatures, hand writing and left thumb impressions did not tally at the time of giving written examination and further they confessed their guilt.
Submission is of false implication and that the petitioners have got no criminal antecedent, chargesheet has already been submitted and there is no chance of tampering with prosecution evidence and in other identical case bearing Mithanpur P.S. Case No. 199 of 2015 accused persons have been allowed bail as such the petitioners also deserve sympathetic consideration to which the learned APP fairly submits that chargesheet has already been submitted and there is no chance of tampering with prosecution evidence.
In the facts and circumstances stated above, the petitioners of all the three applications are directed to be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Mithanpura (Muzaffarpur) P.S. Case No. 200 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
