JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 283, 120-B, 341, 323, 353, 431 and 504 of the Indian Penal Code. The prosecution case is that 12 FIR named accused persons and 40-50 unknown blocked the N.H. 106 making protest against theft by putting burning tyre on the road. When the police reached they misbehaved with police.

It is submitted by the learned counsel for the petitioner that accusation is against the mob. The mob was protesting against the inaction of the police. The police in order to save his skin lodged the present case. Statement has been made in paragraph - 3 of the petition that the petitioner has got no criminal antecedent.

No.3150 of 2016 (2) dt.20-01-2016 2/2 Considering the facts aforesaid, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Birpur (Supaul) in connection with Raghopur P.S. Case No. 45 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
