2. The petitioner seeks regular bail in connection with Sugauli (Bettiah) Rail Police Station Case No. 73/2023 lodged under Sections 379 and 411 of the Indian Penal Code.

3. As per the prosecution case, the F.I.R. has been lodged against the petitioner against whom there is allegation that he has committed theft of mobile.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that petitioner has falsely implicated in this case and his name has figured in this case only on suspicion.

5. Counsel for the petitioner submits that petitioner is in custody since 01.12.2023 having one criminal antecedent in which he is on bail.

6. Counsel further submits that the offence under which the petitioner has been charged, is magisterial triable in nature.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Learned court of Railway Judicial magistrate 1st Class Bettiah- West Champaran in connection with Sugauli (Bettiah) Rail Police Case No. 73/2023 subject to the following conditions as laid down under Section 437(3) of Cr.P.C.

9. However, the petitioner shall be granted bail only on being satisfied by the Trial Court that the petitioner is not absconding in any of the cases pending against him whose details are as follows:- i. Narkatiaganj Rail P.S. Case No.7 of 2022.
