====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 06-08-2025 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in connection with Daudpur P.S. Case No.63 of 2025 for the offences registered under Sections 317(5) of the B.N.S., 2023.
3. As per the prosecution case, on vehicle checking a bike without number plate coming from Badwa village and the rider after seeing the police party left the bike and fled away. Upon checking the said bike a Aadhar card named as Harendra Kumar Ram found and it has been found that the said Harendra Kumar Ram is on bail in theft cases and he sell and purchase the theft bike. The name of petitioner came in confessional statement of co-accused Harendra Kumar Ram.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that petitioner was not apprehended from the
Patna High Court CR. MISC. No.35216 of 2025(3) dt.06-08-2025 2/2 spot and no incriminating article has been recovered from his possession. Learned counsel submits that name of petitioner is transpired in this case by the co-accused due to village politics. He further submits that petitioner has 7 criminal antecedents, out of which, 4 cases belong to the Excise Act and he is on bail in all the said cases. Learned counsel submits that similarly situated coaccused namely Harendra Ram @ Harendra Kumar Ram @ Bhuar Ram has been granted regular bail by the Co-ordinate Bench of this Court vide order dated 15.05.2025 passed in Cr. Misc. No.31086 of 2025. Petitioner is in custody since 18.03.2025 and he undertakes to co-operate in the trial.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saran at Chapra/ concerned Court in connection with Daudpur P.S. Case No.63 of 2025.
