JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 18-06-2020 The petitioner has put to challenge an order dated 16.03.2018 issued under the signature of Civil Surgeon-cumChief Medical Officer, Gaya, whereby, the deputation of the petitioner in Sub-Jail, Sherghati was cancelled with immediate effect.

Earlier when the matter was taken up on 04.05.2018, a direction was issued for maintenance of status-quo, till the next date of hearing.

Learned counsel for the petitioner informs that the petitioner attained the age of superannuation and has retired

Patna High Court CWJC No.8329 of 2018(5) dt.18-06-2020 2/2 with effect from 31.12.2019 and he accordingly, submits that this application, to the extent same relates to challenge to the order of transfer has become infructuous.

He has, however, submitted that despite interim order of status-quo, the petitioner has not been paid his salary from the impugned date, till the date of his superannuation. The petitioner shall be at liberty to raise his grievance before the competent authority, seeking payment of salary for the period in question.

This application stands disposed of with the liberty as aforesaid.
