Case No.42 of 2014, wherein offences punishable under Sections-255, 258, 259, 260 and 420/34 of I.P.C. was alleged. One Himanshu Kumar was also shown as another accused. The allegation was that the accused have supplied fabricated nonjudicial stamps. Apprehending his arrest, the petitioner filed A.B.P. No.18862 of 2014 in the court of learned Sessions Judge, Patna. The same was dismissed on 31.3.2014. Hence, this application for anticipatory bail under Section-438 of Cr.P.C. Heard learned counsel for the petitioner and learned P.P. for the State.

Patna High Court Cr.Misc. No.21698 of 2014 (5) dt.02-07-2015 2/2 accused is very serious. It is brought to the notice of this Court that Himanshu Kumar was arrested and granted bail. In a way, the allegation against the petitioner is more serious. Therefore, the question of granting anticipatory bail to him does not arise. It is, however, directed that in case the petitioner surrenders before the trial court and files an application for bail, the same shall be considered at the earliest.
