Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case instituted for the offences under Section 366(A) of the Indian Penal Code and section 8 of POCSO Act.

The prosecution case in short is that the daughter of the informant went missing and the accused person forcibly abducted the daughter of the informant for the purpose of marriage.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 1.8.2020 and has got no

Patna High Court CR. MISC. No.34650 of 2020(2) dt.18-01-2021 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. There was a love affairs between the petitioner and the victim. The victim had left the house out of her own will to get married with the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cum- Special Judge, POCSO, Madhepura in connection with POCSO Case No. 28/2020 (Puraini P.S. Case No. 124/2020).
