JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in protestcum-complaint registered for the offences punishable under Sections 323, 380, 504, 354/34 of the Indian Penal Code. It is alleged that petitioner no. 2 molestated with the complainant. On protest being made subsequently the accused persons came with Lathi and Danda assaulted the informant. The husband of the complainant came to rescue and he was also assaulted. It is alleged that petitioner no. 1 snatched wrist watch from Binod Yadav, whereas the petitioner no. 3 took away the
Patna High Court Cr.Misc. No.2834 of 2016 (2) dt.19-01-2016 2/2 utensils worth Rs. 2000/-.
It is submitted by the learned counsel for the petitioners that the accusation is against Anant Kumar petitioner no. 2. Petitioner nos. 1 and 3 have been roped in since Anant Kumar petitioner no. 2 is son-in-law of petitioner no. 1. Petitioner no. 3 is the wife of petitioner no. 2.
Considering accusations which has been found false and one year thereafter the protest-cum-complaint petition was filed consequently cognizance has been taken and has not been sent up for trial, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Complaint Case No. 37 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
