The petitioner seeks bail in anticipation of his arrest in connection with Shambhuganj P.S. Case No. 90 of 2020 dated 14.04.2020 instituted for the offences under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code.

The petitioner though is alleged to have assaulted the informant on his head but the injury suffered by the informant is simple in nature. Learned counsel for the petitioner has submitted that there is a dispute over a plot of land over which claim has been staked by the petitioner and the informant both.

Patna High Court CR. MISC. No.33704 of 2020(2) dt.18-03-2021 2/2 Apart from this, it has been submitted that there is a counter version of the occurrence also. The petitioner does not have criminal antecedents.

Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Banka in connection with Shambhuganj P.S. Case No. 90 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
