The petitioner seeks bail in connection with Khagaria Muffasil P.S. Case No. 186 of 2014 registered for the offences punishable under sections 25(1-B)(a), 26 and 35 of the Arms Act. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 16.09.2014 passed in Cr.Misc. No. 32824 of 2014 with following observations : "Since the petitioners are in custody, the learned Chief Judicial Magistrate, Khagaria is directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within nine months from the date of receipt/production of a copy of this order, failing which the petitioners would be entitled to renew their prayer for bail."
Patna High Court Cr.Misc. No.47465 of 2015 (2) dt.04-11-2015 2/2 It is contended that the application for bail of the coaccused Ram Sharan Yadav was also rejected by this Court by a common order on 16.09.2014 while rejecting the application for bail of the petitioner. However, Ram Sharan Yadav has subsequently been granted bail by this Court vide order dated 12.08.2015 passed in Cr.Misc. No. 37036 of 2015. It is further contended that till date the trial has not been concluded. Regard being had to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria Muffasil P.S. Case No. 186 of 2014.
