JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.

The prosecution case is that on 06.10.2015 at about 7.30 p.m. when the informant was in his house the petitioners came and took the informant for somewhere else. On the way the other son of petitioner no. 1 Dharmendra Rai came there with motorcycle and started abusing the informant and took out his pistol. The petitioners tried to catch hold the informant and Dharmendra Rai caused injury to the informant on his hand.

It is submitted by the learned counsel for the petitioners

Patna High Court Cr.Misc. No.3188 of 2016 (2) dt.20-01-2016 2/2 that the accusation of firing is not against the petitioners. Statement has been made in paragraph-3 that the petitioners have got no criminal antecedent.

Considering the facts aforesaid, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, Patna in connection with Danapur P.S. Case No. 570 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
