JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with S c No. 731 of 2014 arising out of Complaint Case No. 1479-C of 2012 for the alleged offence punishable under Section 498A of the Indian Penal Code.

The petitioner is the husband of the complainant. He is in custody since 13.8.2015. Learned counsel for the petitioner submits that the matrimonial dispute between the petitioner and the complainant is the reason behind the institution of the concerned Complaint Case No. 1479-C of 2012. Learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.47697 of 2015 (2) dt.04-11-2015 2/2 opposite party no.2, on the other hand, submits that the petitioner is not paying her the maintenance amount as directed by the court of the Principal Judge, Family Court, West Champaran. Be that as it may, in view of the nature of accusation and submission advanced on behalf of the parties, this application is allowed.

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, West Champaran at Bettiah in S C No. 731 of 2014 arising out of Complaint Case No. 1479-C of 2012.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
