JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2019 This is an application for grant of anticipatory bail in connection with Barhiya P.S. Case No. 91 of 2019 disclosing offences under Sections 420, 406, 34 of the Indian Penal Code. Prosecution case is that Police has received an information that the gang of doubling of the amounts standing near the station, on which, police surrounded them and arrested, who described the modes operandi and the petitioners are working as constable in R.P.F.

Submission of the learned counsel for the petitioners is that there is no occurrence of doubling the amounts as occurred and they have made accused only on the disclosure of the co-accused and as a matter of fact, they have falsely been implicated in this case, as there was some misunderstanding

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai, in connection with Barhiya P.S. Case No. 91 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
