Patna High Court CR. MISC. No.30789 of 2020(4) dt.06-01-2021 2/3 The petitioners are languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. According to FIR, unknown criminals looted away bag of the informant containing cash. Name of the petitioners surfaced in the confessional statement of co-accused. Submission is that investigation of the case is already complete and the petitioners were never put on Test Identification Parade during investigation nor any incriminating article was recovered from their possession. Co-accused Md. Rizwan @ Babu has already been allowed bail by a coordinate Bench of this Court.
Considering the submission aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Mohania P.S. Case No.141 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
