JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 506, 504, 379 and 34 of the Indian Penal Code. The prosecution case is that on 19.10.2015 at about 8.00 p.m. the accused persons including the petitioners came there armed with knife and lathi and started beating the informant. When the wife and daughter of the informant came to rescue they have also assaulted them. Thereafter, they destroyed the articles of the shop and took away cash from the shop.

It is submitted by the learned counsel for the petitioners that petitioner no. 1 is the own niece of the informant whereas

Patna High Court Cr.Misc. No.3174 of 2016 (2) dt.20-01-2016 2/2 petitioner no. 2 is the wife of own brother of the informant. In the background of property dispute and partition suit the accusation has been leveled against the petitioners. The accusation of causing injury is omnibus and general. The injuries are found to be simple in nature.

Considering the accusation omnibus and general and the petitioners being ladies, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Kotwali P.S. Case No. 244 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J.) KKSINHA/N.H.
