JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Ashok Paper Mill PS Case No. 14 of 2015 for the alleged offences punishable under Sections 147, 148, 341, 323 and 302 of the Indian Penal Code, which is pending before the court of learned Assistant Chief Judicial Magistrate, Darbhanga.

Learned counsel for the petitioner submits that there is general and omnibus allegation against this petitioner and other co-accused persons of assaulting the deceased with lathi. He submits that with identical allegation, one of the co-accused, Vikku Mandal, has been granted bail by this Court vide order, dated 13.08.2015, passed in Cr. Misc. No. 30690 of 2015.

Considering the submission as above, this

Patna High Court Cr.Misc. No.47928 of 2015 (2) dt.23-11-2015 2/2 application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Assistant Chief Judicial Magistrate, Darbhanga, in Ashok Paper Mill PS Case No. 14 of 2015. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
