JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379, 307 and 34 of the Indian Penal Code. The prosecution case is that the accused persons entered into the house of the informant started abusing and assaulting the informant. They also damage the household articles and snatched ornaments of the informant.

It is submitted by the learned counsel for the petitioners that the petitioners are agnates of the informant. The injury report states only one lacerated injury caused by hard and blunt substance. The injury is simple in nature. The accusation leveled against the petitioners is omnibus and general against three

Patna High Court Cr.Misc. No.3199 of 2016 (2) dt.20-01-2016 2/2 accused persons. For the occurrence dated 15.09.2015, the case was registered on 20.09.2015. There is counter version of the occurrence also.

Considering the facts aforesaid, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 787 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J.) KKSINHA/N.H.
