Mr. Anish Chandra, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 17-03-2023 Heard learned counsel for the petitioner, learned counsel for the Opposite Party No.2 and learned counsel for the State.

Learned counsel for the opposite party submits at the very outset that the present revision application has been filed with a prayer to set aside the order dated 30.11.2016. He has no objection in setting aside the order.

Counsel for the petitioner submits that due to inadvertence, such type of pleading has been made but in the prayer portion it has been prayed that O.P. No.2 was directed to pay the monthly maintenance till decision of the Hon'ble Court and therefore, he is confined his prayer only upto extent that the

Upon calculation, it comes that the arrear of amount is dues since 76 months and Rs.2000/- per month has been fixed as maintenance amount, as such there are total Rs.1,52,000/- due against the petitioner till date.

O.P. No.2 is ready to deposit the said amount i.e. Rs.1,52,000/- within two months in the account of the petitioner. The account shall be provided by the petitioner before the Principal Judge, Family Court, Vaishali at Hajipur itself. Counsel for the petitioner seeks withdraw this application in the light of the undertaking given by the O.P. No.2.

Hence, the present criminal revision application is disposed off.
