JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 195C of 2005, in which cognizance has been under Section 498A, of the Indian Penal Code.

This case is under Section 498A of the I.P.C. with an allegation of demand of scooter and golden chain and subjecting the complainant to cruelty and torture.

On appearance of the opposite party No. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 16.10.2019. The report of Mediator is available on record at Flag "P". But from perusal of the report it appears that Opposite Party No. 2 has not

Patna High Court CR. MISC. No.37352 of 2019(4) dt.21-10-2019 2/2 appeared before the mediator as such mediation failed. Submission of the learned counsel for the petitioner is that the whole allegation is false and concocted and he is ready to keep her with full dignity and care.

On the other hand, learned counsel A.P.P has opposed the prayer of bail on the ground that proclamation has been issued against the petitioner as such he does not deserve anticipatory bail.

None appeared on behalf of the O.P. No. 2.

In this case it appears that earlier provision bail was granted to the petitioner vide order dated 20.06.2019. In view of the stand of the petitioner that he is ready to keep the complainant with full dignity and care, this application is disposed of with direction to the petitioner that he will surrender before the Court below, who consider the facts as stated above and confirm the provisional bail bonds of the petitioner granted by a coordinate Bench of this Court vide order dated 20.06.2019 with condition that he is ready to keep the complainant with full dignity and care.
