JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-07-2022 After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 06.12.2017, passed by the Assistant Inspector General of Registration, Tirhut Division, Muzaffarpur before the appellate authority, however it is submitted that the appeal of the petitioner be directed to be decided on merits. The learned counsel for the respondent- State submits that in case, appropriate appeal is filed, the same shall definitely be considered on merits.
Patna High Court CWJC No.9415 of 2018(3) dt.25-07-2022 2/2 Having regard to the facts and circumstances of the case, the petitioner is granted liberty to challenge the aforesaid order dated 06.12.2017, by filing appropriate appeal and in case, such an appeal is filed within a period of four weeks from today, the same shall be considered on merits, without being impeded by the issue of limitation and appropriate decision shall be taken thereon, expeditiously. It is needless to state that no coercive action shall be taken against the petitioner, in case the appeal is filed within a period of four weeks from today, till the disposal of the said appeal to be filed by the petitioner. The present writ petition stands disposed off on the aforesaid terms.
