Mr.Satyendra Narayan Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as Mr. Satyendra Narayan Singh, the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection with Buddha Colony P.S. Case No. 418 of 2022, registered for offence punishable under Section 394 of the Indian Penal Code. The charge-sheet was filed under Sections 394, 412 of the Indian Penal Code and Section 27 of the Arms Act and cognizance has been taken under Sections 395, 397, 412 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, three unknown miscreants fired on the father of the informant and took away his bag containing lunch box and some documents.

The learned counsel for the petitioner has submitted that there is nothing against the petitioner except confessional

Patna High Court CR. MISC. No.36862 of 2023(2) dt.03-07-2023 2/2 statement of co-accused Gopi Thakur. No T.I.P. has been conducted and on exactly similar footing, co-accused Rahul Kumar @ MOD @ MOR @ Rahul Raj has been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 16839 of 2023.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of Sawyam Shrivastava, learned J.M.F.C., Patna in connection with Buddha Colony P.S. Case No. 418 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
