In this case, the petitioner is seeking bail in connection with Sessions Trial No.174 of 2014, arising out of G.R.P. Jamalpur (Rail) P.S. Case No.28 of 2013, registered for the offences under Sections 302, 326, 201/34 and 120(B) of the Indian Penal Code.
Earlier this Court has refused to grant bail to the petitioner with a direction to the trial Court to conclude the trial within a period of nine months from the date of receipt / production of a copy of the order and liberty was granted to the petitioner to renew his prayer for bail if the trial is not concluded within the stipulated period.
Patna High Court Cr.Misc. No.47543 of 2015 (3) dt.13-01-2016 This Court had called for the report from the Ad-hoc Additional Sessions Judge, V, Lakhisarai, where it has been mentioned that already warrant has been issued for the production of the witnesses. At this stage, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the trial Court is directed to conclude the trial within a period of nine months from the date of receipt / production of a copy of this order. If the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail. (Shivaji Pandey, J) pawan/- U
