The petitioner has filed this petition for modification of the order 21.07.2015 passed in Cr. Misc. No. 27124 of 2015 by which the petitioner was granted provisional bail on the undertaking of the petitioner that he will deposit 20% of Rs. 55,76,317/- within six months but the petitioner did not deposit 20% of the aforesaid amount within six months and filed a petition for extension of time for depositing the amount. It is submitted that petitioner has already deposited 20% of the aforesaid amount, of course, after six months. It appears from the report of the learned Chief Judicial Jehanabad that bail bonds of the petitioner has already been

Patna High Court Cr.Misc. No.3842 of 2016 (3) dt.03-08-2016 2/2 cancelled as the petitioner did not deposit 20% of Rs. 55,76,317/- in time.

If the petitioner surrenders before the court below, i.e., learned Chief Judicial Magistrate, Jehanabad in Kodhauna P.S. case No. 157 of 2015, and prays for regular bail, the learned court below shall take lenient view on the bail petition of petitioner as the petitioner has already deposited the amount, as directed by this court.

With the aforesaid observation, the modification petition is disposed of.
