Manglam, learned counsel for the petitioner and learned A.C. to A.A.G.-6 for the State. The petitioner has preferred the present writ application against the recommendation made by the respondent no. 3 i.e. District Magistrate, Nalanda at Biharsharif to the respondent no. 2 i.e. Principal Secretary, Panchayati Raj Department by which the District Magistrate has recommended for removal of the petitioner under Section 18(5) of the Bihar Panchayati Raj Act, 2006.

Learned counsel for the petitioner submits that final

Patna High Court CWJC No.1043 of 2021(4) dt.06-10-2021 2/2 order with regard to removal of the petitioner from the post of 'Mukhiya', Gram Panchayat Raj, Tulsigarh, Block- Chandi, District- Nalanda at Biharsharif has not been passed by the respondent no. 2 based upon the recommendation of the respondent no. 3 and the tenure of 'Mukhiya' has now come to end and fresh election has been announced. Accordingly, this writ application has become infructuous.
