2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the prosecution case, 150 litres of countrymade liquor has been recovered from the bank of river Gandak.

4. It is submitted on behalf of petitioner that the petitioner has got criminal antecedent of similar nature.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances and the fact that the recovery has been made from an open place and petitioner has got criminal antecedent of similar nature, in the event of arrest/surrender within a period of six weeks from
