Petitioner is in custody in connection Rosera P.S. Case No. 61 of 2019 for the offence under sections 272, 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that in the instant case total 12 liters of liquor was seized. Learned counsel submits that nothing was recovered from the conscious possession of the petitioner. He submits that similarly circumstanced other co-accused have been granted bail in the instant case.

The petitioner is in custody since 17.3.2019. Considering the fact that similarly circumstanced

No.34524 of 2019(2) dt.27-05-2019 2/2 other co-accused have been granted bail by this Court, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Samastipur, in connection with Rosera P.S. Case No. 61 of 2019.
