JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-07-2022 Heard the learned counsel for the petitioner and Sri Shailendra Kumar, the learned APP for the State. The petitioner apprehends his arrest for the offences alleged under Section 302/34 of the Indian Penal Code, registered in connection with Banka P.S.Case No. 247 of 2019. As per allegation, the informant saw the present petitioner with co-accused Sudama Choudhary and Kartik Choudary catching hold of his father. They were equipped with arms. The informant saw that the accused persons murdered his father after assaulting him on his head by sharp-cutting weapon. The learned counsel for the petitioner has submitted that altogether seven injuries were found on the person of the

Patna High Court CR. MISC. No.46126 of 2021(3) dt.05-07-2022 2/2 deceased, but all the injuries were caused by hard and blunt substance.

On the other hand, the learned APP has submitted that the witnesses have supported the entire occurrence and post mortem report shows that the deceased was badly assaulted by the accused persons. He sustained seven injuries on his person. Considering the above facts and circumstances, I do not think it a fit case for anticipatory bail to the petitioner.
